Terms and Conditions – Worksheets, Materials and Tutoring
Service
1.0 Introduction
1.1 This site is operated and owned by Enthuse Education Ltd. 20-22 Wenlock Road, London. N1
7GU. Registered in England and Wales number: 07493702
2.0 Copyright and Use of the materials
2.1 The copyright and all other intellectual property rights in all materials created by Enthuse is
vested in Enthuse Education Ltd or its licensors.
2.2 You are granted a limited personal non-exclusive licence, to use the agreed materials to work
with the agreed named child, and may only use the Enthuse Education Ltd materials for
personal non-commercial use.
2.3 No material in whole or in part may be modified, copied, reproduced, re-published, uploaded,
posted, transmitted or distributed in any way. Any such use is strictly prohibited and will
constitute an infringement of the copyright and other intellectual property rights of Enthuse
Education Ltd, or in the case of material licensed to Enthuse Education Ltd, the owner of
such materials.
2.4 You also agree not to delete, change or modify in any way the copyright notices on the
materials.
2.5 The use of the Enthuse Education Ltd service is solely for your personal and non-commercial
use. The materials we provide are designed for the use of one person. Use of these materials
by multiple people without our authorization may result in immediate termination of our
service with no refund. Please note that breach of copyright and or terms of use may result in
civil claims or prosecution.
2.6 If the use of the Enthuse Education Ltd materials is found to be used in an inappropriate way
we may cancel the service without refund and we reserve the right to take legal action as
necessary.
3.0 Enthuse Education Ltd Materials
3.1 Whilst Enthuse Education Ltd endeavours to ensure that its materials are a valuable
educational tool bringing real benefits to students and their parents/guardians, Enthuse
Education Ltd cannot be held responsible for the progress of any individual child. Our
research has shown that most children will make very good progress using our materials, but
the progress of each individual is also affected by circumstances out of our control, such as
the amount of positive support the child receives at home and in school and the natural ability
of the individual child, as such we cannot guarantee improvement in all cases.

3.2 All efforts have been made to ensure that the material is accurate and complete. However, if
you discover any typographical errors, please contact us at
customerservices@enthuseeducation.co.uk, and we will seek to rectify the situation
immediately. You are solely responsible for all service, telephone calls to ourselves, printing
of your own materials, and/or other fees and costs associated with your access to and use of
the Services.
3.3 Enthuse Education Ltd. uses all reasonable endeavours to ensure adherence to national
curricula and standards, however this is not a guarantee.
3.5 We advise that to get optimum use from the Enthuse Education Ltd materials, the user needs
to follow the user notes on how to use the materials.
4.0 Enthuse Education Ltd tutors
4.1 All Enthuse Education Ltd tutors are fully certified to teach in England and Wales.
4.2 When you register, you will be assigned to a specific tutor. Enthuse Education Ltd reserves
the right to change your tutor as necessary, and to provide a cover-tutor during periods of
tutor illness or holidays.
5.0 Consumer Protection
5.1 Whilst every effort is made to ensure that our materials do not contain any error, defect,
malfunction or corruption, Enthuse Education Ltd does not accept responsibility for any
damage to or loss of data on your computer system, network or server that results from the
download or use of our materials.
5.2 Nor does Enthuse Education Ltd accept responsibility for loss of data including both data
transmitted and other data held by you, or delay, or failure, in transmitting or receiving data,
or indirect, or consequential losses arising from use of Enthuse Education Ltd Materials,
including loss of revenue, business, anticipated savings on profits.
5.3 Although research has shown that use of the Enthuse Education Ltd materials will increase a
child’s mathematical ability, Enthuse Education Ltd does not make any representation or
warranty that the materials will meet your expectations or requirements, or that any particular
results will be obtained from their use.
5.4 In the unlikely event that you are not completely satisfied with the service you should contact
us by email at customerservice@Enthuseeducation.co.uk and customer service will contact
you within 3 days and will use all reasonable endeavours to deal with issues arising.
6.0 Termination and Suspension
6.1 Your right to use the service will be suspended or terminated immediately and without notice
by Enthuse Education Ltd, if in Enthuse Education Ltd's sole discretion, you fail to comply
with any term or provision of the Terms, or if a competent regulatory authority requires
Enthuse Education Ltd or any of its suppliers to do so. Refunds for any suspension period, or
any remaining subscription period after termination will not be issued.

7.0 Availability
7.1 Enthuse Education Ltd uses all reasonable endeavours to ensure that the material is sent to
you on the appropriate day each week. However, there will be occasions when this may not
happen, due to tutor illness etc. You agree that Enthuse Education Ltd shall not be liable to
you, or any third party, for any modification, suspension or discontinuance of the service.
Every step will be taken by Enthuse Education Ltd to minimise disruption.
7.2 If any so called ‘forced majeure’ event beyond our control happens we reserve the right to
suspend or terminate the service and if the circumstances continue for more than a 3 months,
then either party can terminate the arrangement by written notice.
7.3 Your subscription entitles you to receive a weekly tutoring pack via email, of which you are
responsible for printing, unless printed versions are purchased. It also entitles you to
reasonable support from your tutor in completing your pack. Enthuse Education Ltd has set
the definition what constitutes ‘reasonable’ and ‘unreasonable’ support, as application to the
package agreement that was purchased.
7.4 Enthuse Education Ltd cannot be held responsible for any loss, damage or disruptions that are
inherent in the operation of the Internet and World Wide Web including viruses.
8.0 Payment
8.1 Enthuse Education Ltd only provides products or services once it has received a payment
through PayPal or notification and payment through a third party organisation where Enthuse
has provided a tuition offer. By using the PayPal service for Enthuse Education Ltd products
or services, you are expressly agreeing that we are permitted to bill you a one off or recurring
subscription fee, as agreed, and that you agree to pay the agreed fees for the service.
8.2 As used in these Terms of Use, "billing" shall indicate either a charge or debit, as applicable,
against your Payment Method, including a checking account, where applicable. The
subscription fee will be billed at the beginning of your subscription and your membership will
automatically renew for successive agreed recurring subscriptions, without prior notice to you,
unless and until you cancel your membership or we terminate it.
8.3 You can cancel your membership at any time, through Paypal. In this event you agree that
Enthuse Education Ltd may contact you to discuss what has happened and future options.
8.4 The billing cycle will depend on the type of plan you have selected to subscribe. For example,
if you have bought a six month subscription, you will be billed at the beginning of the
subscription and subsequently after that at the same billing cycle. On a monthly subscription,
we will automatically bill your Payment Method each month on or near the calendar day
corresponding to the commencement of your membership.
8.5 We may change the fees and charges in effect, or add new fees and charges from time to time,
but we will give you advance notice of these changes by e-mail.

8.6 If your Payment Method reaches its expiration date, your continued use of the service
constitutes your authorization for us to continue billing that Payment Method and you remain
responsible for any uncollected amounts.
8.8 Enthuse Education Ltd reserves the right to change prices, from time to time or in line with
inflation, but will always provide advance notice to current customers, and any current 6
monthly or annual subscriptions will remain unaffected. Enthuse Education Ltd reserves the
right to offer promotions periodically to certain groups of customers and thus not available to
all customers.
8.9 You have the statutory right, as a consumer, to cancel your order at any time within 14
days of your submission and receive a full refund, provided you have not started to
receive our services. You do not need a reason, no notice is required and there are no penalties
for cancelling. Just email tutor@enthuseeducation.co.uk if you wish to cancel. You may
also need to cancel payments with your payment provider. We will endeavour to provide all
refunds within 5 working days on request and expect to provide refunds much sooner in most
cases.
8.10 Enthuse Education Ltd will provide refunds, upon request, in the event of termination and none
renewal of service for the last monthly period of tuition service only (whether full price or pro
rata). Eg. If the tuition is for 12 months at half price the final month will be refunded at the half
price rate). Previous service paid for, prior to the final monthly payment date, will not be
considered for refunds.
8.11 Early termination requests will always be granted. Upon request, Enthuse Education Ltd will
also provide refunds for any unused tuition periods, left as a result of an early termination,
using our fair refund policy. The fair refund policy would work by subtracting the cheapest
normal cost* of the tuition, for the time period the tuition has been used, from the total cost
paid on the subscription taken out by the customer. Eg A 12 month subscription cancelled after
7 months with a refund request made would be calculated as the total used (6 months at 65%
full price plus one month full price) subtracted from the total paid for that subscription (12
months at half price) = £207.72 – (£135.02+£34.62) = £38.08 refund for the remaining 5
months. Under no circumstances will cancellation incur any further charges to you beyond the
original agreement. *prices available outside any special promotion prices.
8.12 Enthuse Education Ltd will not provide refunds for payments made through a third party. If a
refund is desired in this situation you will need to refer to the agreement you have with the
third party and make any requests directly to the third party.
9.0 Miscellaneous
9.1 The Terms contain the full and complete understanding between the parties. They supersede
prior arrangements and understandings whether written or oral appertaining to the subject
matter of the Terms. Enthuse Education Ltd reserves the right to amend and/or vary the
Terms from time to time in its entire discretion.
9.2 The Terms and all representations, obligations, undertakings and warranties contained in it,
shall endure for the benefit of any successors and assignees of Enthuse Education Ltd. The
Terms and any contracts made under them shall be governed and construed in accordance
with the laws of England and Wales whose courts shall be the exclusive courts of competent
jurisdiction.

9.3 The failure by Enthuse Education Ltd to enforce at any time or for any period any one or
more of the provisions of these Terms of Use shall not be a waiver of them or of the right at
any time subsequently to enforce all provisions of these Terms.
9.4 If any provision of these Terms of Use shall become or shall be declared by any court of
competent jurisdiction to be invalid or unenforceable in any way, such invalidity or
unenforceability shall in no way impair or affect any other provision all of which shall remain
in full force and effect.
9.5 Enthuse Education cannot provide any guarantee of rate of progress or level of achievement
for any child involved with our tuition process. Progress and achievement are regularly
monitored and our tutors will offer suggestions if necessary. The Enthuse Education Ltd
refund policy, set out in section 8 of this document, dictates that tuition, from a financial
liability point of view, moves forward on a monthly basis. The weekly nature of
communication and activity between parent and tutor is designed to minimise risk of lack of
progress occurring without discussing other support measures in the timely fashion.
